Terms of Use
Last updated: 21 September 2026
Welcome to Truly Gourmet.
These Terms govern your use of www.trulygourmet.co (“Site”) and purchases made directly through the Site. By accessing the Site, creating an account or placing an order, you agree to these Terms.
Nothing in these Terms excludes or limits any right or remedy that cannot lawfully be excluded under applicable Malaysian law.
1. Use of the Site
You may use this Site for lawful personal or business purposes.
You must not misuse the Site, interfere with its operation, attempt unauthorised access to any account or system, introduce malicious software, scrape or reproduce substantial portions of the Site for commercial purposes without permission, or use the Site in violation of applicable law.
We may restrict or suspend access where reasonably necessary to protect the Site, our customers, our systems or our legal rights.
If you are under 18 years old, purchases should be made with the involvement of a parent or legal guardian.
2. Products and Product Information
We sell food products, including Truly Gourmet Tempeh Chips.
We take reasonable care to ensure product descriptions, images, prices, ingredients, pack sizes, certifications and other information shown on the Site are accurate.
Packaging, photography or presentation shown online may occasionally differ slightly from the product supplied due to packaging updates, printing variations, screen display differences or product updates. Any such difference will not alter the essential nature of the product supplied.
For ingredient, allergen, storage, best-before and other food information, customers should also refer to the information provided on the physical product packaging.
If information on the Site appears inconsistent with information on the current product packaging, please contact us for clarification.
3. Prices
Unless stated otherwise, prices displayed on the Malaysian Site are in Malaysian Ringgit (RM).
The total payable amount, including the product price, delivery charges, applicable taxes and other applicable charges, will be shown before you confirm your order.
Prices, promotions and availability may change from time to time.
A price change will not normally affect an order already accepted by us unless there is an obvious pricing or technical error.
Promotional codes, vouchers, bundles, loyalty rewards or other promotional benefits may be subject to additional conditions displayed at the time of the promotion.
4. Orders
You may review and correct your cart, quantities, delivery details and other order information before submitting an order.
After an order has been submitted, we will provide an electronic acknowledgement without undue delay.
If you notice an error after placing your order, contact us as soon as possible. We will make reasonable efforts to correct the order where practicable.
Changes may no longer be possible once an order has been packed, handed to the courier or dispatched.
Submitting an order does not necessarily mean that we have accepted it.
We may decline or cancel an order where, for example:
- a product is unavailable;
- payment cannot be completed;
- delivery is not reasonably possible;
- fraud or unauthorised activity is suspected;
- incorrect information has been provided; or
- there is an obvious pricing or technical error.
If we cancel an order after payment has been successfully collected, the relevant amount will be refunded using the original payment method or another agreed method.
5. Payment
Available payment methods are displayed during checkout and may change from time to time.
Payments may be processed by third-party payment service providers. Your use of a payment method may therefore also be subject to the relevant payment provider’s terms and privacy practices.
Truly Gourmet does not require customers to send complete credit or debit card details directly to us by email, WhatsApp or other informal communication channels.
An order is not considered paid until the applicable payment transaction has been successfully authorised or received.
6. Delivery
Available delivery destinations, delivery charges and estimated delivery times are displayed on the Site and/or during checkout.
Delivery estimates are estimates rather than guaranteed delivery dates unless we expressly state otherwise.
Delivery may be affected by courier operations, public holidays, weather, customs procedures, remote-area delivery, incorrect customer information or circumstances outside our reasonable control.
Customers are responsible for providing a complete and accurate delivery address and contact information.
Where delivery cannot be completed because the customer supplied incorrect or incomplete information or failed to accept delivery, reasonable additional delivery charges may apply.
For international orders, the customer may be responsible for customs duties, import taxes, clearance charges and compliance with destination-country import requirements unless otherwise stated during checkout.
7. Damaged, Defective, Incorrect or Materially Different Products
If you receive a product that is defective, damaged, incorrect or materially different from what was ordered, please contact us promptly.
We may request reasonable supporting information, including:
- your order number;
- photographs of the product;
- photographs of the packaging;
- batch or best-before information; and
- details of the issue.
Where applicable, we will provide an appropriate remedy in accordance with applicable Malaysian consumer law.
Where a product is defective, incorrect or materially different from what was ordered, we will bear applicable re-delivery costs where required by law.
Nothing in this section limits any statutory guarantee, remedy or right available to you.
8. Change-of-Mind Returns
Because Truly Gourmet products are food products, we generally cannot accept returns solely because a customer changes their mind after delivery.
This is particularly applicable where packaging has been opened, damaged or tampered with.
This restriction does not apply where the product is defective, unsafe, incorrect, materially different from what was ordered, or where the customer otherwise has a remedy under applicable law.
Any additional refund or cancellation conditions displayed on the Site form part of these Terms.
9. Food Storage and Consumption
Customers should store and consume products in accordance with the instructions shown on the packaging.
Do not consume a product where the packaging appears materially damaged, unsealed, unusually inflated, tampered with or otherwise unsuitable for consumption.
Please contact us if you have concerns about a product received.
Information provided on the Site concerning food, nutrition, ingredients or general wellbeing is provided for general informational purposes and is not intended as medical advice or as a substitute for advice from a qualified healthcare professional.
10. Accounts
You may be able to create a customer account to manage orders or access other Site functionality.
You are responsible for:
- providing accurate information;
- maintaining the confidentiality of your login credentials; and
- activity conducted through your account.
Please notify us if you reasonably believe your account has been accessed without authorisation.
We may suspend or close an account where reasonably necessary because of fraud, misuse, security concerns or serious violation of these Terms.
11. Reviews and User Content
Customers may have the opportunity to submit ratings, reviews, photographs, comments or other feedback.
Reviews should reflect genuine experience and must not contain:
- knowingly false or misleading information;
- unlawful material;
- threats or harassment;
- discriminatory content;
- spam;
- malicious content; or
- material that infringes another person’s rights.
We may moderate or remove content where reasonably necessary for legal, security, authenticity or community-management purposes.
By submitting content for publication, you grant Truly Gourmet a non-exclusive, worldwide, royalty-free licence to display, reproduce and use that content in connection with Truly Gourmet and its marketing, subject to applicable privacy and consumer law.
Reviews represent the views of the individual reviewer and do not necessarily represent Truly Gourmet’s views.
12. Intellectual Property
Unless otherwise indicated, the Site and its contents, including photographs, graphics, copy, video, designs, product artwork, characters, logos and other brand material, are owned by, controlled by or licensed to Truly Gourmet.
You may access and use Site content for personal and non-commercial purposes.
You may not reproduce, distribute, modify, sell, license or commercially exploit our Site content or brand assets without prior permission, except where permitted by law.
Nothing on the Site grants any licence or right to use any trademark, logo, character, product artwork or other intellectual property belonging to Truly Gourmet or another rights holder.
13. Third-Party Websites, Retailers and Marketplaces
The Site may contain links to retailers, marketplaces, social-media platforms, payment providers, couriers or other third-party services.
Those services operate independently and may have their own terms, privacy policies and consumer-protection procedures.
Purchases made through third-party retailers or marketplaces are generally governed by the terms applicable to that retailer or platform.
These Terms principally govern purchases made directly through www.trulygourmet.co.
14. Privacy and Cookies
Personal information collected through the Site is handled in accordance with our Privacy Policy and applicable Malaysian data-protection law.
The Site may use essential, analytics, functional, advertising or other cookies and similar technologies.
Further information about these technologies may be provided through our Privacy Policy, Cookie Notice and/or cookie-consent controls.
Where consent is legally required for a particular use of personal information or technology, we will seek that consent where applicable.
15. Availability of the Site
We aim to keep the Site available and accurate, but uninterrupted access cannot be guaranteed.
We may temporarily suspend, maintain, update or modify the Site where reasonably necessary.
We may also correct:
- typographical errors;
- incorrect pricing;
- inaccurate product information;
- product availability;
- technical errors; or
- other Site errors.
Where a correction materially affects an order already placed, we will contact the customer where reasonably necessary.
16. Liability
Nothing in these Terms excludes or restricts liability that cannot lawfully be excluded or restricted.
Nothing in these Terms limits a consumer’s statutory rights under applicable Malaysian law.
Subject to those rights, Truly Gourmet will not be responsible for losses arising solely from circumstances outside our reasonable control or losses that were not reasonably foreseeable in connection with the relevant transaction.
Where you use the Site or purchase products wholly for business purposes, different statutory rights may apply from those available to individual consumers.
17. Events Outside Our Control
We will not be responsible for delay or failure caused by events outside our reasonable control.
These may include:
- natural disasters;
- severe weather;
- major transport disruption;
- government action;
- war or civil disturbance;
- widespread telecommunications or internet failure;
- labour disruption;
- epidemics or public-health emergencies;
- courier-network disruption; or
- failures affecting essential third-party infrastructure.
Where such an event affects an order, we will take reasonable steps to minimise disruption and communicate with affected customers where appropriate.
18. Changes to These Terms
We may update these Terms from time to time to reflect changes to our Site, products, services, business operations or applicable law.
The latest version and revision date will be published on this page.
Changes will generally apply from the date they are published.
Changes will not retrospectively remove rights already acquired under an order previously accepted by us.
19. Governing Law and Consumer Disputes
These Terms are governed by the laws of Malaysia.
If a problem arises, customers are encouraged to contact us first so that we can attempt to resolve the matter directly.
Nothing in these Terms prevents an eligible consumer from exercising any right available under Malaysian law, including bringing an eligible claim before the Tribunal for Consumer Claims Malaysia (TTPM) or another competent authority or court.
20. Severability
If any provision of these Terms is found by a competent authority or court to be invalid, unlawful or unenforceable, that provision will be treated as modified or removed only to the extent necessary.
The remaining provisions will continue to apply.
